How National Park Policies may affect your Planning Application

Tree Preservation Order (TPO)

A mechanism for securing the preservation of single or groups of trees of acknowledged amenity value. A tree subject to a tree preservation order may not normally be topped, lopped or felled without the consent of the local planning authority.

Conservation Areas

Areas of special architectural or historic interest, the character or appearance of which it is desirable to preserve or enhance.

Flood Risk

An assessment of the likelihood of flooding in a particular area so that development needs and mitigation measures can be carefully considered.

Contaminated Land

Land that has been polluted or harmed in some way making it unfit for safe development and usage unless cleaned.

Article 4 Directions

In some areas the Authority may remove permitted development rights by issuing an Article 4 direction. This will mean that a planning application must be submitted for work which normally does not need one. Article 4 directions are made when the character of an area of acknowledged importance would be threatened. You will probably know if your property or land is affected by such a direction, but you can check with the Authority if you are not sure.

Article 3 Restrictions

Article 3 means that in certain circumstances the normal permitted development rights do not exist and therefore a planning application is required:
i) a permission granted in connection with an existing building and building operations involved in the construction of that building are unlawful or
ii) if permission is granted in connection with an existing use and that use is unlawful
